LEGAL AND MORTGAGE OFFICER
 
QUALIFICATION STANDARD:
Education : Bachelor's Degree in Law/Juris Doctor
Experience : 2 years of relevant work experience in Social Work; and
Training : 8 hours of relevant training
PREFERRED KNOWLEDGE & SKILLS:
Subsidiary Ledgers and Reconciliation Account Management
DUTIES & RESPONSIBILITIES:
Plans, leads, organizes, and controls the accounts in the remedial management stage on the operationalization of strategic programs, activities, and projects through establishing the operational status, the nature of the financial condition, the legal standing, and the valid and legal capacity to act in behalf of and for the community association towards its statutory effects and efficient implementation such as but not limited to the undistributed collection, restructuring, and condonation program, substitution, collection, and individualization, release of the title, and rehabilitation of dysfunctional CA organization;
Conducts on-site inspection and group validation based on the gathered data of the operational status, nature of the financial condition, legal standing, and the valid and legal capacity to act on behalf of and for the community association/s;
Orients and assists dysfunctional Cas/MBs in reorganizations and in securing buy-in rehabilitation;
Conducts on-site orientation or seminar on ledgering to ensure distribution of Statement of Account, Individualization, and Substitution for the Community Association/s;
Processes and facilitates the legal requirements and processes in the application for: a) Collection, b) Loan Restructuring, c) Loan Restructuring Agreement (LRA), and Promissory Notes (PN) to qualified MBs for loan restructuring under RA 9507, c) Substitution, d) Individualization, e) Release of Title, undistributed collections and the like;
Supports the conduct of alternative dispute mediation, resolution, and settlement of issues within the ADR (alternative dispute resolution) level pertaining to CMP and, in other cases recommended to the parties to settle issues through proper authority which has jurisdiction of the allegations in their complaint such as DHSUD, Courts, LGU, LRA, SHFC Legal and the like;
Diagnoses and recommends a continuous process of improvement in the systems and procedures in preparation of Statement of Accounts, List of payments, abstract of accounts, and other reports pertaining to CA's account;
Evaluates and recommends the process in the legal documentation and compliance of requirements for restructuring, MRI enrollment, substitutions, closing of UC by FCD bookings, and turnover of rehabilitated or for foreclosure of accounts to concerned departments; and
Performs other related functions that may be assigned from time to time.
