Job Description
THE OPPORTUNITY

In this role, the Business Practice and Ethics Manager supports the Leadership in the planning and implementation of a Local Compliance Program to ensure country day-to-day operations are in adherence with applicable laws, policies, procedures both locally and globally.
Provides compliance expertise to the business, working with line managers and relevant support group, and includes local implementation of tools/ systems to support controls, training & communication, and monitoring of key risk indicators at country level to maintain a strong compliance culture and infrastructure.
The function also serves as the point of contact for the Legal & Compliance Organization for the implementation of global and regional compliance and risk management initiatives.
WHAT YOU WILL DO
Local Compliance Program
Collaborate with the Country Leadership Team and the Compliance Working Group to establish a Local Compliance Program with an objective to embed compliance into everyday business practices
Collaborate with the Legal & Compliance Organization (LCO) to ensure regional and global compliance initiatives are incorporated and implemented in the country
Designated as the Secretary of the Compliance Working Group (CWG)
Risk Management, Governance & Investigation
Conduct or oversee due diligence evaluation on individuals or in the conduct of CME events in accordance to Local Business Practices & Compliance Standards, and with anti-bribery & corruption (ABC) or FCPA requirements (including administrator and/or approver in the ABC System)
Support the review of the due diligence documentation, including facilitation of the Compliance Training Materials & conduct of training to the third party, related support as required by the business (e.g. system administrator of the 3rd Party ABC system, Document Retention as per contract management process, etc), "red flag remediation", escalation to LCO as required, provision and tracking of Compliance KPIs in contracts, and ensure that the due diligence process is updated timely as required by corporate policy on anti-corruption
Develop and or implement assessment tools to measure state of compliance
Conduct quarterly Risk Assessment to periodically evaluate/identify risk areas and control processes (e.g. Expense Reimbursement, Engagement with HCPs, Sampling, Grants, etc.) and facilitate the CWG review of Risk Management Analytics (e.g. Pulse)
Support MSE Group to ensure integrity of process and systems through oversight and validation of systems and processes that impact on employee rewards and incentives (e.g. Sales Processing, Incentives, Awards) and performance management (e.g. Personal Performance Objectives)
Prepare monthly Compliance Status Report for the Compliance Working Group (CWG) meeting
Prepares and serves as the custodian of CWG Meeting Minutes and CWG Report/Findings
Coordinate pre-audit and audit activity; support CLT/CWG in the development, implementation and tracking of post-audit remediation plan
Collaborate with CWG to drive remediation and organizational enhancement and follow through with stakeholders to ensure next steps or actions are taken
Support CCO/LCO in the assessment and monitoring of emerging risks, enforcement activities and regulatory trends including the conduct of Enterprise Risk Management as necessary
Works as Country Privacy Steward and support country management in completing the Annual Privacy Certification
Support CCO/LCO in fact finding and/or investigation activities as requested in line with the Compliance Issue Visibility and Response (CIVR)
Business Support
Identify and communicate laws, codes of conduct, and regulations that affect the country, and/or Merck globally and support the CCO/LCO by working with local business process owners to incorporate global policies / divisional or regional guidance into local SOPs. Escalate/consult with CCO/LCO for guidance on compliance standards, and other applicable regional or global policies when appropriate
Work with process owners to address requirement for local SOPs, and facilitate the inventory, development, review, revision, and ensure distribution of local SOPs (with the appropriate business owner) and document retention (assure access, archive, align with information management)
Partner with the business as consultant or advisor to ensure alignment of day-to-day business decisions on local business practices & compliance standards, and applicable global or regional policies, and industry laws and guidelines
Escalate to CCO/LCO new programs/initiatives for appropriate CCO/LCO or applicable review board
Conduct field work to observe or monitor conduct/implementation of business practices, and partner with stakeholders to identify and understand compliance capability building needs
Work with business process owners to identify inefficient or ineffective business processes (e.g. CME events) and through a cross functional approach streamline such processes, including enhancements of systems (e.g. MSD Connect) and/or elimination of roadblocks to compliance
Training & Communication
Work with CLT, CWG and line managers to identify compliance capability building needs and prepare a Training & Communication plan to address these
Partner with HR, Learning & Development team, Communications and/or liaise with CCO/LCO to support the On-Boarding Curriculum for new hires or new to role, and employee refresher initiatives through the development of training modules and communications
Provide department heads of compliance training, reports and updates
Collaborate with department leads and line managers in the implementation of compliance capability building initiatives (e.g. department stewards, conduct of TTT, innovative training solutions) and drive training cascade of managers to their teams to ensure that all employees are educated on all required company policies and procedures, industry codes, and other relevant laws and regulations
Prepare individualized communication of Compliance Working Group findings as agreed upon in CWG meetings for cascade and action of relevant department unit heads
Support CCO/LCO in the local cascade or implementation of global or regional training programs
Support the business/program owners to communicate and provide training-related requirement of 3rd Party
Track and communicate compliance training completion and ensure retention of supporting documents (e.g. attendee list) of training implementation
Support the LCO in communicating emerging trends, new policies, procedures and expectations to the local organization
Special Projects
May lead or support strategic initiatives and other ad-hoc projects such as, business process improvement that impact on Business Practices and Compliance or company operations as a whole
Works with Legal & Compliance Organization (LCO) to participate or as point on contact for LCO global or regional compliance projects
Helping the business to ensure that new programs/initiatives are submitted to the applicable Review Board or L&C (through local processes or otherwise), helping the business to ensure that implemented programs adhere to the guidance and MSD policies and procedures
WHAT YOU MUST HAVE
To be successful in this role, you will have:
University degree in Business Management or relevant
Minimum 5 years or more working experience in pharmaceutical or healthcare industry (Sales, Marketing or Finance)
BPO experience is preferred; or minimum 3 years' experience as District Manager or Product Manager
Substantial supervisory experience, 3 years or more
Knowledgeable and passionate for ethical conduct and compliance
Detail oriented and work effectively with cross-functional team
Excellent communication skills, confident
Good English, written, oral and presentation skills
